Terms & Conditions

1. Definitions
In these Terms and Conditions:
- "Agreement" means these Terms and Conditions together with any service engagement letter.
- "Service" means the family legal consultation, advice, planning, or mediation services provided by Duangjai Counsel.
- "User" or "Client" means any individual who engages with our website or services.
- "We / Us / Our" refers to Duangjai Counsel, 51 Wireless Road, Pathum Wan, Bangkok 10330, Thailand.
- "Content" means written summaries, agreements, and other documents produced by us in connection with our services.
- "Website" means the site operated at duangjaicounsel.cyou.
2. Acceptance of Terms
By using our website or engaging our services, you confirm that you are at least 18 years of age, have the legal capacity to enter into a binding agreement, and accept these Terms and Conditions in full.
If you are acting on behalf of another person in connection with our services, you confirm you have the authority to do so and accept these terms on their behalf as well as your own.
3. Service Description
Duangjai Counsel provides the following family legal services in Thailand:
- Sensitive Separation Advice — legal advice and written overview for individuals navigating separation.
- Child Care and Support Planning — assistance with parenting arrangements and support documentation for families with children.
- Mediation and Agreement Support — facilitated mediation and formal drafting of family agreements for cooperative separations.
Services are available to individuals located in Thailand or those whose matters fall under Thai civil law. We work in both Thai and English.
Our services are legal information and facilitation services. We do not provide court representation as part of the above service packages. If court attendance is required, this will be discussed and agreed separately.
4. Engagement and Scope
A service engagement begins when:
- You have had an initial consultation with our team;
- You have confirmed your wish to proceed with a specific service; and
- You have received and accepted a service confirmation from us.
The scope of each engagement is as described under the relevant service. Any additional work outside that scope will be agreed in writing before proceeding.
5. User Responsibilities
When using our services, you agree to:
- Provide accurate and complete information relevant to your matter.
- Not use our services for any purpose that is unlawful under Thai law.
- Engage in good faith with the mediation or planning process.
- Communicate changes in your circumstances that may affect the advice or arrangements being prepared.
- Keep any written materials provided by us confidential where they concern third parties.
6. Intellectual Property
All content on the Duangjai Counsel website — including text, design, and structure — is owned by or licensed to us and may not be reproduced, distributed, or adapted without our prior written consent.
Written summaries and agreements produced for your specific matter are provided to you for your personal use in connection with that matter only. They may not be reproduced or shared without our consent.
7. Fees and Payment
Service fees are stated in Thai Baht (฿) and confirmed in writing before any service work begins:
- Sensitive Separation Advice: ฿1,440
- Child Care and Support Planning: ฿2,850
- Mediation and Agreement Support: ฿4,100
Payment is due upon confirmation of engagement and prior to delivery of any written documents. Payment methods will be communicated at the time of engagement.
Fees do not include government filing fees, court fees, or any third-party costs, which remain the client's responsibility.
8. Cancellation and Refunds
If you cancel an engagement before any work has been carried out, you are entitled to a full refund of the fee paid.
If work has commenced, a partial refund proportional to the work not yet completed may be issued at our discretion.
Cancellations must be notified to us in writing at [email protected].
9. Confidentiality
We treat all information shared with us in the course of providing services as confidential. We will not disclose your information to any third party without your consent, except where required by Thai law or a court order.
This obligation of confidentiality continues after the conclusion of our engagement.
10. Disclaimers
Our services are provided with professional care, but we do not make any representation that a particular outcome will be achieved. Family law outcomes depend on many factors, including the decisions of other parties and, where applicable, the courts.
Information provided on our website is for general informational purposes only and does not constitute legal advice in relation to your specific situation.
11. Limitation of Liability
To the extent permitted by Thai law, our total liability in connection with any service engagement shall not exceed the fee paid for that engagement.
We shall not be liable for any indirect, consequential, or incidental damages arising from the use of our services or website.
12. Termination
Either party may terminate a service engagement by written notice. Where we terminate due to a material breach of these terms by the client, no refund is payable for work already completed.
Where a client terminates, the refund provisions in section 8 apply.
13. Governing Law and Dispute Resolution
These Terms and Conditions are governed by the laws of the Kingdom of Thailand.
Any dispute arising from these terms or our services shall first be addressed through informal discussion. If not resolved, the parties agree to attempt mediation before initiating any formal legal proceedings.
Any legal proceedings shall be brought before the courts of Bangkok, Thailand.
14. General Provisions
- Entire Agreement: These Terms, together with any service engagement letter, constitute the entire agreement between the parties.
- Severability: If any provision of these Terms is found invalid, the remaining provisions continue in full force.
- Waiver: Failure to enforce any right does not constitute a waiver of that right.
- Notices: All notices under these Terms should be sent to [email protected].
15. Changes to These Terms
We may update these Terms from time to time. Changes will be published on this page with a revised effective date. Continued use of our website or services following any update constitutes acceptance of the revised Terms.
